Read through Splash Swim School Limited terms and conditions. Acceptance of your request for enrolment shall constitute your acceptance of the terms and conditions.

Fees and Payment

Fees are charged on a per term basis and are due and payable in full prior to the start of term to confirm your child’s place in the class. Any places where fees remain outstanding your child’s place in the class may be offered to other children.

Refunds

You will not be entitled to any refund for lessons missed due to conflicting activities, holidays or if you choose to miss a lesson. Once the term begins you cannot cancel your class placement and no refunds are given.

Should fees continue to remain unpaid the booking may be cancelled.

The only exception to the above is in the event of the child suffering from a prolonged illness or injury, which must be evidenced to Splash by way of a Doctor’s Certificate. Where applicable, any lessons already delivered will be deducted from the refunded fees.

Cancellations and Postponements

Lessons may be cancelled at short notice if the pool is not fit for teaching purposes.

In the unfortunate event we have to cancel or postpone a lesson, we will notify you as soon as possible via the method that we believe is most appropriate to ensure you have received the message in a timely manner. We will endeavour to add an alternative date, offer to substitute the lesson or provide a credit. No refunds will be offered. If you notify us that you are unable to attend the substitute lesson in advance of the date scheduled for the substitute lesson, then you will receive a credit for the cancelled lesson. This credit may be offset against your fees for a subsequent term. If you do not accept the substitute lesson, or do not wish to re-enrol for a subsequent term, we are not obliged to provide a refund but may do this at our discretion.

If we determine that there is insufficient support for a class, we have the right to cancel, suspend or postpone the class before the date of the first lesson. We shall give you as much notice as possible of any such cancellation and we will provide you with a full refund of your term fees if no suitable alternative class is found. Our liability for any such cancellation shall be limited to this refund and we shall not be liable for any losses of any kind incurred by you because of such cancellation.

Class Size or Instructors

While we will try our best to ensure consistency and quality, we cannot guarantee a particular class size or instructor. These may be changed on a temporary or permanent basis once a class has started.

Your Responsibilities

You are responsible, at all times, for any children that you bring from arrival on the premises, irrespective of whether they are participating in lessons or not. This includes supervision in the changing rooms and in any other part of the premises.

Children are not the responsibility of Splash or the instructor until the child enters the pool at the start of a lesson. You need to collect your child, promptly, at the end of the lesson.

If you must leave the pool area whilst your child is in the pool please let the Instructor or reception know, as in the event that your child needs to go to the toilet during a lesson, the instructor will ask you to supervise them.

We will not accept liability for loss or damage to any personal belongings brought onto the premises. You are therefore requested to ensure that no valuable items are brought to the lessons.

Whilst you are on the premises, we ask you to respect our rules and all property. Access to any other sites and surroundings (other than the pool facility) on the premises is used by authorised people of the property owner only, and will be at your own risk.

Given the inherent dangers associated with swimming, In the event that you or anyone associated with you refuse to obey an instruction from our staff, or behave in an unacceptable manner towards our staff or any other person or causing damage to property, your child will not be permitted to continue with the lesson and you will be asked to leave the premises immediately. We may also (at its sole discretion) terminate your enrolment without further notice, and without being required to offer any credit or refund, and you shall not be accepted for any future classes.

Personal Information and Privacy

We are committed to your right to privacy and the safeguarding of your personal information. We reserve the right to collect personal information from you for the purposes of enrolment. This information will be held on file and used to assist us in providing swimming services and for any other purpose you may authorise. We undertake to only use, deal with or disclose your personal information and maintain your privacy in accordance with the Privacy Act 1993 and any subsequent amendments or variations thereof.

Recording Images

We may record some classes and events in which your child participates, and general images of your child will form part of the personal information we hold and use. You consent that we may use these recordings and images for education and training, marketing and promotion, and swimmer performance analysis and development purposes.
